Legal Aid is available in all cases of civil contempt of Court proceedings before the High Court, regardless of your income.
Many people don't think they need legal representation in civil contempt cases because it sounds more minor without the stigma of the “criminal” label. This is not the case – in civil contempt cases the burden of proof is far lower than for a criminal allegation but a loss of the case can still result in a prison sentence or other sanctions which can be indefinite.
Civil contempt of Court can involve:
- Any failure to meet the requirements of a Court – for example if you have been required to provide documents but have refused to
- Times where the Court has made an undertaking and its alleged that you have breached the undertaking
- Breach of a High Court injunction. Locally that is most likely to be breaching the Black Country Car Cruising Injunction or the Traveller Injunction
