What is a slip/trip claim?

A claim following a slip may be caused by liquid or other contamination leaving a floor slippery. You may trip over a dangerous defect such as defective paving, a pothole in a poorly maintained driveway, or a dangerous obstruction on a walkway.

You may fall from a height or down stairs due to there being no hand rails or defective handrails available. There are many instances which may give rise to a person to become injured due to a slipping or tripping incident.

FAQs

Who is responsible for the accident?

This depends on where the accident happened and who was responsible for the maintenance of the area where you slipped or tripped.  This may be a private company, your employer, or a local authority.  It is important to contact us as soon as possible following the accident as sometimes it is not clear who is responsible and we are experienced at establishing who the relevant Defendant shall be and how to obtain their insurance details.

How long do I have to make a claim?

Generally there is a three year limitation window.  If the injured party is a child (under the age of 18 years)  the three year window begins on the child’s 18th birthday.  It is our advice that you do not delay and present the claim as soon as possible following the incident.

How much compensation will I get following a trip/slip?

There is no set amount of compensation.  All cases are different, and are valued upon their own circumstances and medical evidence.  There are however tools available to assist with valuing Personal Injury claims such as the Judicial College Guidelines, researching similar past cases, but particularly our expertise and experience from dealing with many previous cases for victims of slip/trip claims.  We aim to maximise damages for our clients and ensure you receive the compensation that you are entitled to.

Can you assist in recovering medical treatment costs?

In claims where liability is accepted by the Defendant, insurance companies are often willing and able to offer and arrange physiotherapy treatment or other medical rehabilitation.  We are experienced in assisting to obtain recommended treatment and advising in relation to medical evidence in slip and trip claims.

Can I claim for loss of earnings due to time off work following a slip?

If you are forced to take off work due to your injuries and lose out on pay then a claim for loss of earnings can be presented to the Defendant.  We shall assist in ensuring the medical evidence deals with the absence from work and assist in gathering evidence in support of the loss of earnings.
