What is a Sexual Offence?

The term sexual offence relates to a range of offences which can include rape, historic abuse cases and child sexual offences.

What is the Sexual Offences Act 2003?

The Sexual Offences Act 2003 is UK legislation which covers all the different types of sexual offences, including how severe they are and how they’re categorised. It almost fully replaced the Sexual Offences Act 1956 and is more precise. Some examples of the offences this covers are rape, sexual assault, child sex offences, sex trafficking and consent.

What Does Consent Mean?

Consent is covered in section 74 of the Sexual Offences Act 2003. It defines sexual consent as follows: “if he agrees to what’s happening by choice, and having the freedom and ability to make or change that choice.” 

For a defence about consent to be successful, the accused must show they reasonably believed that the victim genuinely consented. There are certain offences where consent can’t be used as a defence, such as in child sexual abuse cases.

Is Bail Available in Sexual Offence Cases?

Yes, it is available, but it’s not always guaranteed. If it is granted, strict bail conditions may be put in place, such as restricted contact with any victims and witnesses and travel limitations.
