Pre-Charge Representation Solicitors

What is Pre-Charge Representation?

Pre-charge representation is the facility where following interview under caution, and before any charges are formally brought, the police will continue to investigate the allegations with a view to sending the file to the Crown Prosecution Service for a charging decision.

Prep-Charge representation enables individuals to be legally represented and make representations to the police and Crown Prosecution Service, with a view to avoiding charges ever being brought.

In such circumstances we analyse pre-charge evidence and investigate the case so, if required, statements can be obtained and served on the police in the spirit of avoiding charges being brought.

There are many people who can simply not afford to be charged for any offences in any circumstances as that could lead to loss of employment for those employed in certain professions, and the negative connotations that can arise depending on the type of allegations being investigated.

How Does Pre-Charge Representation Work?

The solicitors’ aim is to influence the outcome of / charges will be made against the accused. Pre-charge representation can look different depending on the case. Typically, a solicitor will:

  • Identify any weak points in a police investigation
  • Give you advice on how to conduct yourself during interviews and the answers you should provide.
  • Find further information and evidence which proves your innocence
  • Act on behalf of the suspect

Is Pre-Charge Representation Worth it?

There are many benefits of engaging in the pre-charge representation system, primarily this will ensure that the investigation is dealt with properly, that any leads are followed up and not missed by the police, which unfortunately is a seemingly common occurrence.

Individuals can be advised as to their legal rights, evidence can be tracked down and documented at an early stage in order to avoid difficulties later on.

If successful, charges can be avoided, which in turn avoids the need for any Court trial and additional expense that could bring.
