At Waldrons, we understand that being accused of a drug driving offence can be very stressful, and the penalties can be life-changing. We’re here to help increase your chances of achieving the outcome you’re aiming for through expert representation and practical, easy-to-understand legal advice.
What is Drug Driving?
Drug driving is covered by two offences in UK law. This involves Section 4 of the Road Traffic Act 1988, which focuses on whether an individual is unfit to drive through legal or illegal drug use. Section 5A of the Road Traffic Act 1988 focuses on drug driving limits and whether the specific drug exceeds the legal amount. The legal limits for different drugs vary.
What are the Penalties for Drug Driving?
Someone convicted of drug driving could receive:
- A driving ban for a minimum of 1 year
- Up to 6 months of prison time
- An unlimited fine
- A criminal record (your driving licence will also reflect that you’ve been convicted for drug driving for 11 years).
If you cause someone’s death through careless driving while under the influence of drugs, you could receive life in prison.
