What is Drink Driving?
This is when someone drives, attempts to drive, or is in charge of a motor vehicle on a road or other public place after consuming more than the legal limit of alcohol. It’s not possible to know how many drinks or units of alcohol will put someone over the legal limit, because this is different for everyone. The legal limits are determined by the content of alcohol found in someone’s breath, urine or blood.
What is the Legal Limit?
England, Wales, and Northern Ireland:
- 35 micrograms per 100 millilitres of breath
- 107 milligrams per 100 millilitres of urine
- 80 milligrams per 100 millilitres of blood
Scotland:
- 22 micrograms per 100 millilitres of breath
- 67 milligrams per 100 millilitres of urine
- 50 miligrames per 100 mililitres of blood
What are the Penalties for Drink Driving?
The penalties given depend on the severity of the drink driving offence and are decided by the magistrates who hear the case.
If someone’s in charge of a vehicle while above the legal limit or is unfit through drink, they may be penalised with:
- 3 months in prison
- A fine worth up to £2,500
- A potential driving ban
If someone drives or attempts to drive while above the legal limit or unfit through drink, or refuses to provide a specimen of breath, urine, or blood for analysis, they may be penalised with:
- 6 months in prison
- An unlimited fine
- A driving ban for at least a year (3 years if convicted twice within 10 years)
If someone causes death by careless driving while under the influence of alcohol, they could get:
- Life in prison
- An unlimited fine
- A driving ban for at least 5 years and an extended driving test before their licence can be returned.
