What Constitutes Dangerous Driving?
Section 2A of the Road Traffic Act 1988 explains that someone may be charged with dangerous driving if the way they drive falls far below what’s expected of a driver who’s competent and careful, and it would be obvious to a competent and careful driver that driving in this way would be dangerous. Someone may also be charged with dangerous driving if it would be obvious to a driver who is competent and careful that driving the vehicle in its current state would be dangerous.
What are the Penalties for Driving Dangerously?
Dangerous driving carries with it a mandatory penalty of a driving ban for a minimum of 12 months. This disqualification remains in effect until they pass an extended driving test. Other penalties given depend on various factors, such as whether the case is charged in the Crown Court or the Magistrates’ Court and whether serious injury was caused. Someone charged with dangerous driving could also face unlimited fines, 3 to 11 penalty points on their licence, and time in prison.
