Environmental Health Prosecutions

Environmental Health teams (usually within local councils) prosecute offences that affect public health and the local environment, but their remit is different from the Environment Agency (EA). They typically prosecute:

  • Unsafe rental properties (e.g. damp, mould, no heating, fire risks)
  • Failure to comply with improvement notices
  • Illegal eviction or harassment by landlords

Example: A landlord fined for failing to fix dangerous electrics or heating, putting tenants at risk.

Food Safety

  • Poor hygiene in restaurants, takeaways, cafes
  • Unsafe food handling or contaminated food
  • Failure to comply with food safety inspections

Example: A food business prosecuted for rodent infestations or storing food at unsafe temperatures.

Noise Nuisance

  • Persistent noise from alarms, music, industrial units, or barking dogs
  • Failure to comply with abatement notices

Example: A nightclub or factory prosecuted for ongoing noise disturbance to neighbours.

  • Smokedustfumesodour, or light pollution from premises
  • Accumulations of waste or filth on land

Example: A business fined for releasing smoke or odours that affect nearby homes.

Pest Control Failures

Health & Safety (at lower-risk workplaces)

  • Breaches at:
    • Offices
    • Shops

    • Hotels
    • Warehouses (not factories—those are HSE’s responsibility)
