In a tragic case, Louise Smith, Clinical Negligence Solicitor at Waldrons Solicitors, successfully secured £42,500 in compensation for the family of MP, a patient whose lung cancer diagnosis was significantly delayed, leading to a shortened life expectancy.
MP was initially diagnosed with Chronic Obstructive Pulmonary Disease (COPD) in 2015. During a CT scan at Worcestershire Acute Hospitals NHS Trust in 2018, a shadow on her lungs was identified. However, no further action was taken at the time.
On 6th June 2019, a chest x-ray revealed a primary tumour in MP’s lungs, later diagnosed as squamous cell carcinoma. By then, the cancer had progressed to her lymph nodes and MP’s condition was classified as Stage 3A, leaving her with palliative care options only. Tragically, MP passed away on 28th September 2021.
How Waldrons Solicitors Secured Compensation
MP’s daughters instructed Waldrons Solicitors to investigate and pursue a claim on behalf of her estate. Two independent medical experts reviewed MP’s care and concluded that:
- The shadow detected on the 2018 CT scan should have led to further investigation and diagnosis at an earlier stage.
- Had the cancer been diagnosed in 2018, it would have been staged at 1A rather than 3A, significantly improving MP’s treatment options and prognosis.
- MP would have been eligible for stereotactic radiotherapy (SBRT), which could have prolonged her life.
Waldrons submitted a Letter of Claim to Worcestershire Acute Hospitals NHS Trust. In their Letter of Response, the Trust admitted liability and causation and offered an apology to MP’s family.
Following negotiations, a settlement of £42,500 was agreed.
