Proceeds of Crime – Interested Party
Are you an interested party in a Proceeds of Crime application relating to a family member or someone with whom you share a financial interest?
You may be entitled to legal aid for such proceedings. A proceeds of crime application can be made by the Crown Prosecution Service after conviction where they determine that the defendant has benefitted financially from the offending, and there are assets available.
Orders Against Financial Assets
You may share a financial interest with someone, and orders could be made against those assets where you hold an interest. Even though you haven’t committed any offence, any order the court make could affect you and your family. Therefore, you are entitled under section 10A proceeds of Crime Act 2002 to have your interest considered in court by the Judge before making a final order.
