Waldrons Solicitors have a contract with the Legal Aid Agency which means we are able to offer services under Legal Aid.
There are eligibility criteria and in some circumstances these can be complicated, however, we are experts in this field and we will be able to advise you swiftly whether your case would qualify for Legal Aid.
Police Station
All people arrested or interviewed at the police station under caution are always eligible for Legal Aid, regardless of income. The solicitor who advises you at the police station will be paid for through the Legal Aid scheme and there is no cost to you.
Magistrates Court
In the Magistrates Court an application for Legal Aid is made to the Legal Aid Agency. There are income thresholds which have to be evidenced as part of that application.
We are able to advise as to eligibility over the phone and if you are unsure whether you may be able to get Legal Aid please call us.
Crown Court
Legal Aid in the Crown Court is means tested, but the income allowed is significantly higher than in the Magistrates Court.
It is sometimes the case that Legal Aid is granted, but that the Legal Aid Agency will ask for a contribution to be paid as top up to the fees.
We are able to advise with regard to this process and advise of the options available to you.
Funding your case yourself
If you are not eligible for Legal Aid – either because of your income or because the type of offence alleged is not covered by the scheme – we are able to defend your case on a privately funded basis.
We will be able to discuss this with you over the phone to ensure that there will be a fair, open and honest price for the work required, which can be paid via instalments if that is easier for you. We will be clear on costs 100% of the time.
Whenever possible we will agree a fixed fee with you so that you have a clear idea from the outset of costs rather than an hourly rate.
