Interested Party – Are you an interested party in a Proceeds of Crime application relating to a family member or someone with whom you share a financial interest?

You may be entitled to legal aid for such proceedings. A Proceeds of Crime application can be made by the Crown Prosecution Service after conviction where they determine that the defendant has benefitted financially from the offending, and there are assets available.

Orders against financial assets –  You may share a financial interest with someone, and orders could be made against those assets where you hold an interest.  Even though you haven’t committed any offence, any order the court make could affect you and your family.  Therefore, you are entitled under section 10A proceeds of Crime Act 2002 to have your interest considered in court by the Judge before making a final order.

It is essential that you obtain independent legal advice in order to protect your interests.

If you have been asked to attend a voluntary interview, arrested or are due to appear in the criminal courts, you have a right to have a solicitor attend the police station with you and, in the event you are charged with offences, you have a right to a solicitor to represent you in court.
