Affidavit for divorce on the grounds of adultery

When you can satisfy the Court that your spouse has received the Divorce papers, usually by receipt of sealed Acknowledgment of Service, you can proceed to the next stage of your divorce, namely application for a date for pronouncement of a Decree.

You must complete the Affidavit providing all information requested. The document must be sworn, or affirmed by you. This can be done free of charge at any County Court office, or by an independent solicitor however a small fee will be charged for this service. 

The Affidavit must then be filed with the Court, together with the Application for Directions for Trial (Special Procedure ) – Form D84. The Court will place your file before the District Judge who will consider the application, and if satisfied will list the matter for a Decree Nisi hearing date. Notice of such date will be sent to you by the Court.
