Holiday or Sickness that is the question

 

A recent case has clarified the situation regarding an employee’s holiday entitlement whilst they are off sick. It is clear that an employee is entitled to accrue statutory holiday entitlement under the Working Time Regulations. However, they are only entitled to be paid for holiday either during their leave or at termination of employment IF they exercise their right to take holiday i.e. by giving you notice.

Unfair?

 

The government have confirmed that from April 2012 the service qualification period for an employee to be eligible to bring a claim for ordinary unfair dismissal will be increased to 2 years.

There are some exceptions to this rule and employers will need to be alive to the fact that as a result allegations of discrimination may increase in order to get claims in for those with less than 2 years service.

Vicarious Liability for non-employees

 

As a business you may be held responsible for the acts of your employees which cause damage to third parties property or person. The High Court ruling recently has opened the door for businesses to also be responsible for non-employees such as consultants, office holders, agency workers etc. Whether the act was committed within the course of employment and the nature of the relationship between the business and the non-employee will be relevant.
