West Midlands solicitors Waldrons has recently won a substantial clinical negligence settlement for a patient who is unable to have any more children following an emergency caesarean section.
Mrs Naurin Ahmed, of Tipton appointed Waldrons solicitors in July 2008 to represent her case against The Dudley Group of Hospitals NHS Foundation Trust, for treatment she received at Russell’s Hall Hospital after her uterus was torn and she suffered a massive haematoma following an emergency caesarean section to deliver her second child, Mohammed, now aged three.
The 43 year-old endured an emergency hysterectomy following the caesarean section, rendering her infertile and unable to complete her family.
Representing Mrs Ahmed, Adam Smith, clinical negligence solicitor from Waldrons said: “Our client suffered permanent fertility loss because she was not treated to a good enough standard during the emergency delivery of her son.
“The case brought against the Trust was that they were negligent in that they caused or permitted a tear to the uterus and failed to diagnose and repair the tear at the time of the caesarean section.
“It is important cases such as this are highlighted, so severe and permanent life-changing consequences as a result of clinical negligence can be avoided in the future.”
Importantly, The Dudley Group of Hospitals NHS Foundation Trust initially denied responsibility in a letter before Court Action. However, once Waldrons issued court proceedings, the Trust then admitted liability and issued a formal apology to Mrs Ahmed.
Speaking after the settlement, Mrs Ahmed says the compensation will help fund the adoption process, enabling her and her husband to achieve their dream of providing another brother or sister for Mohammed and Mr and Mrs Ahmed’s first child, Maryam.
She said: “While I am pleased with the settlement Waldrons have obtained on my behalf, my reason for complaining to the hospital is in hope this will never happen again and that no other woman will lose the ability to have children through negligence after visiting Russell’s Hall Hospital.
“The compensation will in no way replace my lost fertility, but it will help my family grow and provide us with the financial support required to adopt.
“Waldrons has been with me every step of the way through this process and their professional support and guidance has helped my family through this difficult time.”
